Feds will be appealing, there is no way a murder charge won’t be there some way or another.

Adding context. He still not being released or in the clear. He will still have to go to court at the federal level for 2 Federal stalking counts which carry a life sentence without parole. Additionally he still faces 9 state felony counts as well which includes 2nd degree murder. He’s still going to jail. Only outcome this changed for him is no death penalty but just life in prison.
